This is a release of liability. Please read it carefully. By signing, you give up certain legal rights.
In consideration of being permitted to participate in the BEEROX Challenge with Rob Hieken and any related training, activities, and events (the "Activity"), I, the participant, agree to the following on behalf of myself, my heirs, and my legal representatives.
1. Assumption of risk. I understand that the Activity involves strenuous physical exertion and carries inherent risks, including but not limited to muscle strains, sprains, fractures, heart attack, stroke, permanent disability, and death. I knowingly and freely assume all such risks, both known and unknown, and accept full responsibility for my participation.
2. Medical fitness. I affirm that I am physically able to participate and have no medical condition that would make participation unsafe. I understand I should consult a physician before beginning, and that I am not relying on the organizer or trainer for medical advice or screening.
3. Release and waiver. I release, waive, and discharge Rob Hieken and his trainers, employees, agents, and affiliates (the "Released Parties") from any and all liability, claims, demands, or causes of action arising out of any loss, damage, injury, or death I may suffer while participating, whether caused by the negligence of the Released Parties or otherwise, to the fullest extent permitted by law.
4. Covenant not to sue. I agree not to sue and to hold the Released Parties harmless from any claim arising out of my participation in the Activity.
5. Indemnification. I agree to indemnify and defend the Released Parties against any claim, loss, or cost, including reasonable attorney fees, brought by me or on my behalf arising from my participation.
6. Emergency medical care. I authorize the Released Parties to arrange emergency medical treatment on my behalf if needed, at my own expense, and I release them from any liability for such treatment.
7. Consent to contact. I agree to be contacted by email and phone about this challenge and related offerings. I may opt out at any time.
8. Governing law and severability. This agreement is governed by the laws of the State of California. If any part is found unenforceable, the remaining parts stay in full effect.
9. Acknowledgment. I have read this entire release, fully understand it, and sign it freely and voluntarily. By typing my full legal name and checking the box below, I provide my binding electronic signature.
